Purchase

All work is offered for sale on a made-to-order basis.
Normal delivery is 1 to 4 weeks, depending on the complexity of the work and Fx N Metal order backlog at the time of order.
To purchase, click the “Article Inquiry” button on the Product Portfolio item page, fill out buyer info, ask questions about the work, select purchase intent if applicable and click “Send.”
Via email, Fx N Metal will return answer(s) to your questions, and if purchase intent was indicated, a description of the desired item, the estimated delivery, applicable sales tax, total sales amount, purchase terms, any other relevant info, and a secure payment link for payment by credit card will be provided.
Payments are processed by an established and secure ecommerce merchant service provider (Square). Fx N Metal never sees purchaser’s payment details for payment link transactions.
Work starts when invoice is paid.
Shipping confirmation and tracking number is provided when order ships.

Shipping

FedEx Ground shipping within the continental US is included in the price. Any other shipping arrangement is purchaser’s responsibility, cost, and risk.
Packaging to meet FedEx Ground requirements and mitigate damage (double boxing) is included in the price.
All shipments are insured within Fed Ex insurance terms and limits of value for sculpture shipments. Due to Fed Ex shipping insurance coverage limits for sculpture / art, limits of value may not match purchase price. Any FedEx shipping insurance claim refunds for FedEx-accepted shipping damage claims will be provided to the Purchaser and are the sole remedy for any damage claims.
To be a valid claim, any shipping damage must be reported by Purchaser to Fx N Metal within 3 calendar days of receipt and include photos and detailed description of the damage. This claim info will be filed as a shipping damage claim to FedEx Ground by Fx N Metal, the shipper.
If, after review of damage photos provided by Purchaser, shipping damage is repairable, Fx N Metal will provide a repair cost. Any return shipping cost and repair cost is Purchaser’s responsibility. Purchaser should retain packaging material until damage claims and repairs are resolved.
Any shipment destinations outside the continental US are purchaser’s responsibility, including cost and risk.
Non-continental US delivery items will be packed for US destinations and a declaration of origin and Schedule B export number provided to purchaser by email. Packaged item will be made available for customer or freight forwarder pickup.

Refunds/Returns

All Fx N Metal sales are final, non-returnable and non-refundable once order is placed and invoice is paid.

Warranty

Fx N Metal, LLC warrants that:

Its products are original handmade metal sculpture / art products made in the USA and only by David Woody using the materials described for each product on its website.
Its products have been designed and fabricated with a similar standard of care and quality as welded handmade metal sculpture / art products made and offered by other artisans.
It has full legal ownership of its products and the authority to sell same.
The products offered for sale are free from any claims, liens, security interest, pledges, or encumbrances.
It is not aware of any third-party claims or information likely to give rise to any claims concerning the authenticity, provenance, or ownership of its products.
Its products, and the materials of construction, have not been illegally imported.
Sales of its products does not violate the laws of the USA or the state of Texas where the products were fabricated.

This warranty shall not apply to defects or damage arising from any of the following:

Accidents, abrasion, physical impact, abuse, shipping damage, or misuse.
Exposure to extreme temperature, corrosive atmospheres, or precipitants.
Improper installation, handling, mounting or care.

Except as may be provided otherwise on this website, no other warranties, expressed or implied, are made. Under no circumstances shall Fx N Metal, LLC be liable for any Purchaser loss or damage (direct, indirect, or consequential) related to the product loss, damage, or product satisfaction.

Unpacking

Products are packaged for shipment as described in the last bullet in the Care section of this website. To avoid damage / breakage during unpacking, observe the reverse order for unpacking that is described in the Care section packing instruction for transport. Unpacking instructions will also be sent to purchaser via email prior to shipment and a physical copy included with the product shipment.

Breakage due to improper unpacking is not covered by Warranty. To avoid/minimize damage, do not pull or break packaging fasteners holding the metal sculpture in place. Cut and carefully remove all package fasteners.

Mounting

Fx N Metal 3D products, which are displayed on a horizontal surface and all sides except the bottom are visible, only require a stable horizontal surface for display. If needed, these products have elastomeric protectors on the bottom to prevent surface marring.
Selection of display location should take recommendations into consideration as put forth in the Care section of this website.
2D products have mounting points or holes and are intended for mounting on a wall. The document Metal Sculpture / Art Wall Hanging Recommendations (click to view web page) provides mounting recommendations for 2D products. For heavier 2D products or products requiring a more complex hanging method, specific mounting recommendations will be furnished with the product shipment.

Care

Fx N Metal products are welded metal sculpture / art creations and made for indoor display only. Functional products (article number starts w/F) are designed to be used for the function for which they were designed and stated but should not to be regularly handled, manipulated, bent, or excessively moved.

A feather or micro-fiber duster is recommended for dust removal as needed. To avoid damage or breakage of the sculpture / décor (product), the following care guidance points are recommended.

Except for functional products and jewelry, all other products are designed for viewing only.
Handle products with care and limit handling to cleaning and transport activities only.
Products are not intended as toys and should not be handled by children.
Products should be displayed in an area out of children’s reach and with a clearance for walking around them that does not allow brushing against or touching the product.

Point of Caution
Products are made from metal and have sharp edges / points which may cause injury if handled irresponsibly.

Products are designed and coated for indoor display only.
Products should not be submerged in water – clean with duster or lint-free cloth.
Do not bend product materials or materials at or near welds.
When necessary, lift product from its load-bearing base or frame, not from fragile decorative elements of the sculpture.
To minimize the risk of damage, we recommend transport with the product sitting on its load-bearing base or frame and mechanically secured from moving inside the shipping enclosure. Place bubble wrap or protective foam peanuts around fragile product material / components. Any shipping by commercial carrier should be insured, double-boxed with three-inch padding between corrugated boxes, and labeled in accordance with carrier’s standards / requirements.
